Terms and Conditions of Service for TREAT Organizations

By creating an organization structure in TREAT and/or setting up events with TREAT, the organization agrees to the terms and conditions, fees, services, and payment schedules included here and/or in the Agreement betweem TREAT and the organization and the Organization/Event Set-Up form. The organization further agrees to comply with all terms and conditions of the prime vendor, and to grant TREAT access to all data collected pertaining to the organization and/or transactions processed through TREAT.
Services and Fees
Services to be provided by TREAT and the fees associated with those services will be specified in the Agreement.
Payment
- Payment to the organization will be made as specified in the Agreement.
- If an event is cancelled, postponed, or changed, the organization will be responsible for all refunds. Any fees charged by TREAT remain a liability of the organization unless specifically waived by TREAT. Credit card refunds done by TREAT will be charged to the organization at $1.50 per transaction.
- TREAT will charge the organization for each credit card charge back at TREAT's cost even if the charge is later approved by the credit card company. Payment to the organization of these transaction revenues will be withheld until resolved. If rejected, then no revenue will be paid to the organization on these transactions.
- Any sales tax collected through the system will be passed through to the organization. The organization has full responsiblity for any sales tax or corporate tax liabilities.
Warranty Disclaimer
Use of the service is at the organization's own risk. The service is provided on an "as is" basis. TREAT and its affiliates, suppliers, and partners expressly disclaim all warranties of any kind, whether express or implied including but not limited to: (i) the service or any products purchased through the service; (ii) timeliness or security of the service; or (iii) error in the service, wording, or presentation. Upon notice from the organization, TREAT will make reasonable efforts to fix any error. Any materials obtained through use of the service are obtained at the organization's own discretion and risk, and TREAT shall not be responsible for any damage caused to the organization's computers or data by any destructive code resulting from use of the service or any content obtained from the service.
Limitation of Liability
To the fullest extent permitted under law, TREAT and its affiliates, suppliers, and partners have no obligation or liability for any damages or liabilities arising from the organization's use of the service including damages arising from (i) the organization's use of or inability to use our service; (ii) cost of procurement of substitute goods and services; (iii) unauthorized access to or alteration of the organization's user content; (iv) the cancellation or change in any event or program bulit in the system, or (v) any other matter relating to the service. Notwithstanding anything to the contrary contained herein, TREAT's liability and the liability of each of its officers, directors, investors, employees, agents, and contractors under any circumstance is limited to a maximum of one hundred dollars ($100).
Indemnity
The organization agrees to indemnify, defend, and hold harmless TREAT and its affiliates, suppliers, partners, officers, agents, and employees from and against any claims, demands, losses, damages, or expenses arising from any user content, the organization's use of the service, the organization's connection to the service, the organization's violation of these terms of service, or the organization's violation of any rights of or harm to any third party.
If the organization uses TREAT for any fraudulent activity, TREAT may terminate service and file for recovery. TREAT has the right to suspend or terminate service to the organization without notice.
Changes to Terms and Conditions of Service
TREAT may change the terms of service from time to time, and it is the responsibility of the organization to be aware of these changes. Terms and Conditions are available on TREAT's web site, www.TREATickets.com.
TREAT is a 501c3 organization and a nonprofit corporation under the laws of the State of Michigan.
